Welcome to BharatEverify, a subsidiary of BharatEarns.com. These Terms of Use (“Terms”) govern your access to and use of our website www.bharateverify.com, APIs, dashboards, and related services (collectively, the “Services”). By using our Services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please refrain from using our Services.

1. Eligibility

• At least 18 years old
• Legally capable of entering into a binding contract

You are also responsible for ensuring that your use of the Services complies with applicable laws, including data protection and KYC regulations.

2. Services Offered

BharatEverify provides verification APIs for identity, business, and financial data, including (but not limited to:)

• Aadhaar, PAN, GSTIN, Bank Account, and UPI verification
• KYB (Know Your Business) and KYC (Know Your Customer) checks
• API integrations for fintech, insurance, and lending platforms

We reserve the right to modify, suspend, or discontinue any part of the Services without prior notice.

3. Account & Access

• You may be required to create an account to access our API or dashboard.
• Keep your credentials secure. You are responsible for all activities under your account.
• Notify us immediately of any unauthorized access or security breach.

We may suspend or terminate access if we detect suspicious or unlawful activity.

4. Usage Restrictions

You agree not to:

• Use the Services for unlawful purposes or to process unauthorized or fake data.
• Reverse-engineer, decompile, or attempt to extract source code from our APIs.
• Resell, sublicense, or redistribute our services without written permission.
• Use data obtained via BharatEverify in violation of Indian laws, including the DPDP Act, 2023.

Misuse may lead to account termination, legal action, and reporting to regulatory authorities.

5. Information Sharing

We may share your data with:

• BharatEarns.com and its affiliate companies.
• Service providers for hosting, analytics, or customer support.
• Regulatory authorities, law enforcement, or as required by law.

We do not sell your personal data to third parties.

6. Data Privacy

Our Privacy Policy outlines how we collect, store, and protect your data. By using our Services, you consent to our handling of your data in accordance with that policy.

7. Pricing & Billing

• API usage may be subject to pricing plans agreed upon during onboarding.
• All payments are non-refundable unless explicitly stated.
• Overuse or abuse of free tier limits may result in temporary suspension or upgrade prompts.

8. Limitation of Liability

To the fullest extent permitted by law, BharatEverify shall not be liable for:

• Any indirect, incidental, or consequential damages.
• Loss of data, business, or reputation.
• Errors resulting from misuse of our APIs or unauthorized integrations.

Use of the Services is at your own risk.

9. Indemnification

You agree to indemnify and hold harmless BharatEverify and BharatEarns.com, including their officers, affiliates, and employees, from any claims, liabilities, or damages arising out of:

• Your misuse of the Services.
• Your violation of these Terms or applicable laws.
• Any third-party claims related to data you process using our Services.

10. Termination

We reserve the right to suspend or terminate your access at any time, with or without cause, especially if:

• You breach these Terms.
• Your usage poses a risk to other users or to our systems.
• We receive valid legal or regulatory instructions to do so.

Termination does not waive your obligation to pay pending dues or comply with any post-termination legal requirements.

11. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts of District Court Gautam Buddha Nagar, Uttar Pradesh.
